The following are requirements for submitting Digital Millennium Copyright Act (DMCA) notices of infringement and DMCA counter-notices to Interfocus. However, we prefer that you use our reporting form, which allow us to process notices with greater efficiency and enable authorized parties to send notices with quality and ease.
Notice Requirements
To report infringement to Interfocus’s designated agent, please use our reporting form. If you are not able to use the reporting form, please see the requirements below.
If you believe that material residing on or accessible through Interfocus infringes a copyright, you may send a notice of infringement via email to copyright@patpat.com,which must include all of the following required information:
- 1. a signature of a person authorized to act on behalf of the intellectual property owner whose right has been allegedly infringed upon -- signatures may be provided electronically by typing your name;
- 2. identification in sufficient detail of the work allegedly infringed upon;
- 3. identification of the allegedly infringing material on Interfocus including the specific location of the material so that Interfocus can find it -- for listings, please provide the Interfocus listing URL to each item you allege is infringing;
- 4. the name of the intellectual property owner, and contact information for the notifier including name, address, telephone number, and email address;
- 5. a statement that the notifier has a good faith belief that the material is not authorized by the intellectual property owner, its agent, or the law; and
- 6. a statement that the information provided in the notice is accurate, and under penalty of perjury, that the notifier is authorized to make the complaint on behalf of the copyright owner.
If you misrepresent that material is infringing, you may be liable for damages (including costs and attorneys' fees). Therefore, if you are not sure whether the material is infringing, please contact an attorney before submitting a notice to Interfocus. Fraudulent or abusive notices may result in account termination or other legal consequences.
Counter-Notice Requirements
If you have a good faith belief that material removed or disabled as a result of a notification of copyright infringement to Interfocus involved a misidentification or mistake, you may send a counter notice via email to copyright@patpat.com, which must include all of the following required information
- 1. your signature -- signatures may be provided electronically by typing your name;
- 2. identification of the material that has been removed or to which access has been disabled -- for listings, please provide the Interfocus listing URL to each item before it was removed or disabled;
- 3. a statement made under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material;
- 4. your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal Court for the judicial district in which you are located, or if your address is located outside the United States, for any judicial district in which Interfocus is located, and that you will accept service of process from the person who provided the original notification or an agent of such person.
If Interfocus receives a DMCA counter notification, the removed material may be replaced or access to it may be restored 10 business days after receipt of the counter notice, unless the copyright owner files an action seeking a court order against the allegedly infringing party and informs Interfocus of this action. Interfocus sends a copy of the counter notice to the original complaining party.

Repeat Infringement
Interfocus terminates account privileges of members that are subject to repeat notices of copyright infringement in appropriate circumstances and at Interfocus’ discretion.

Wir bevorzugen jedoch die Nutzung unseres Meldeformulars, da dieses eine effizientere Bearbeitung der Mitteilungen ermöglicht und autorisierten Parteien die Einreichung von Meldungen mit höherer Qualität und Benutzerfreundlichkeit gestattet.
Hinweis Anforderungen
Wenn du der Meinung bist, dass auf Interfocus gespeichertes oder über Interfocus zugängliches Material ein Urheberrecht verletzt, kannst du eine Mitteilung über die Rechtsverletzung per E-Mail an copyright@patpat.com senden. Diese muss alle folgenden erforderlichen Informationen enthalten:
- Eine Unterschrift einer Person, die bevollmächtigt ist, im Namen des Inhabers der mutmaßlich verletzten Rechte des geistigen Eigentums zu handeln – Unterschriften können elektronisch durch Eingabe deines Namens erfolgen.
- Eine hinreichend genaue Identifizierung des mutmaßlich verletzten Werks.
- Eine Identifizierung des mutmaßlich verletzenden Materials auf Interfocus, einschließlich des genauen Speicherorts des Materials, damit Interfocus es finden kann – bei Angeboten gib bitte die jeweilige Interfocus-Listing-URL jedes angeblich verletzenden Artikels an.
- Den Namen des Inhabers des geistigen Eigentums sowie die Kontaktdaten des Meldenden, einschließlich Name, Adresse, Telefonnummer und E-Mail-Adresse.
- Eine Erklärung, dass der Meldende nach Treu und Glauben davon ausgeht, dass die Nutzung des Materials weder durch den Rechteinhaber, noch durch dessen Bevollmächtigten oder durch das Gesetz autorisiert ist.
- Eine Erklärung, dass die im Hinweis enthaltenen Informationen zutreffend sind und dass der Meldende unter Androhung von Strafe wegen Meineids bevollmächtigt ist, die Beschwerde im Namen des Urheberrechtsinhabers einzureichen.
Wenn du fälschlicherweise angibst, dass ein Material eine Urheberrechtsverletzung darstellt, kannst du für Schäden haftbar gemacht werden (einschließlich Kosten und Anwaltsgebühren). Wenn du dir also nicht sicher bist, ob das Material eine Verletzung darstellt, kontaktiere bitte vor Abgabe einer Mitteilung einen Anwalt. Betrügerische oder missbräuchliche Meldungen können zur Kündigung des Kontos oder zu anderen rechtlichen Konsequenzen führen.
Anforderungen für Gegendarstellungen
Wenn du nach Treu und Glauben der Ansicht bist, dass Material, das aufgrund einer Mitteilung über eine Urheberrechtsverletzung an Interfocus entfernt oder deaktiviert wurde, irrtümlich oder fälschlicherweise identifiziert wurde, kannst du eine Gegendarstellung per E-Mail an copyright@patpat.com senden. Diese muss alle folgenden erforderlichen Informationen enthalten:
- Deine Unterschrift – Unterschriften können elektronisch durch Eingabe deines Namens erfolgen.
- Eine Identifizierung des Materials, das entfernt oder zu dem der Zugriff deaktiviert wurde – bei Angeboten gib bitte die Interfocus-Listing-URL jedes Artikels an, bevor er entfernt oder deaktiviert wurde.
- Eine Erklärung unter Strafe des Meineids, dass du nach Treu und Glauben davon ausgehst, dass das Material aufgrund eines Irrtums oder einer Falschidentifizierung entfernt oder deaktiviert wurde.
- Deinen Namen, deine Adresse, Telefonnummer und E-Mail-Adresse sowie eine Erklärung, dass du der Zuständigkeit des Bundesgerichts für den Gerichtsbezirk, in dem du dich befindest, zustimmst oder – falls deine Adresse außerhalb der Vereinigten Staaten liegt – für jeden Gerichtsbezirk, in dem Interfocus ansässig ist, und dass du die Zustellung von Verfahrensunterlagen durch die Person, die die ursprüngliche Mitteilung eingereicht hat, oder deren Bevollmächtigten akzeptierst.
Wenn Interfocus eine DMCA-Gegendarstellung erhält, kann das entfernte Material nach 10 Werktagen wiederhergestellt oder der Zugriff darauf ermöglicht werden, es sei denn, der Urheberrechtsinhaber reicht eine Klage ein, um eine gerichtliche Verfügung gegen die angeblich verletzende Partei zu erwirken, und informiert Interfocus über diese Maßnahme. Interfocus übermittelt eine Kopie der Gegendarstellung an die ursprüngliche beschwerdeführende Partei.
Wenn du fälschlicherweise angibst, dass Material keine Urheberrechtsverletzung darstellt, kannst du für Schäden haftbar gemacht werden (einschließlich Kosten und Anwaltsgebühren). Wenn du dir also nicht sicher bist, ob das Material eine Verletzung darstellt oder nicht, kontaktiere bitte vor Abgabe einer Gegendarstellung einen Anwalt. Betrügerische oder missbräuchliche Gegendarstellungen können zur Kündigung des Kontos oder zu anderen rechtlichen Konsequenzen führen.
Wiederholte Rechtsverletzungen
Interfocus beendet in geeigneten Fällen und nach eigenem Ermessen die Kontoberechtigungen von Mitgliedern, gegen die wiederholt Mitteilungen über Urheberrechtsverletzungen vorliegen.
